US sales of bank-owned homes fell in 1st quarter

(AP) ? Bank-owned homes and those in some stage of the foreclosure process saw their share of overall U.S. home sales grow in the first quarter.

The increase was driven by a spike in short sales, or homes that sell for less than what the owner owed on their mortgage, foreclosure listing firm RealtyTrac Inc. said Thursday.

Short sales make up the vast majority of homes sold while still in the foreclosure process. Those that aren't sold or auctioned off typically end up being repossessed by banks, what most people commonly think of as foreclosures.

In the first quarter, short sales grew 25 percent from a year earlier, hitting a three-year high. In contrast, bank-owned properties declined 15 percent versus the first three months of last year, the firm said.

The trend indicates a greater likelihood that home prices will continue to soften, as foreclosures and short sales typically sell at sharp discounts to other homes.

It also suggests a shift in the way lenders handle mortgages that have gone unpaid.

Lenders may be favoring short sales versus waiting for troubled loans to go through the foreclosure process to take back the homes securing the loan, said Daren Blomquist, a vice president at RealtyTrac.

"A short sale is a safer alternative to avoid any potential problems that they face because of the way they're processing foreclosures," Blomquist said.

Last year, mortgage lenders grappled with allegations that they had been processing foreclosures without verifying documents. The pace of foreclosures slowed sharply as the nation's biggest mortgage lenders worked to hammer out a settlement with state and federal officials.

They reached a $25 billion settlement in February, clearing the way for banks to take action on unpaid mortgages.

All told, 233,299 bank-owned homes or those in some stage of foreclosure sold in the first quarter, making up 26 percent of all U.S. home sales in the same period, the firm said.

That's the highest percentage of overall sales since hitting 28 percent in the third quarter of 2010, before the foreclosure abuse claims against mortgage lenders surfaced.

Foreclosure sales made up 22 percent of all sales in the last three months of 2011 and a quarter in the first quarter a year ago.

As of end of April, there were 637,668 bank-owned homes yet to be sold, representing a 17-month supply, Blomquist said. Another 722,467 were in some stage of the foreclosure process.

Sales of all previously occupied homes jumped in January to the highest pace in nearly two years, but declined slightly the next two months. Sales rose 3.4 percent in April from March to a seasonally adjusted annual rate of 4.62 million, according to the National Association of Realtors. That nearly matched January's pace of 4.63 million, but was below the nearly 6 million that most economists equate with healthy markets.

While rising, the share of foreclosure sales remains well below its first-quarter 2009 peak of 45 percent of all sales. They comprised less than 1 percent of all sales in 2005, at the height of the housing boom.

More foreclosure sales also means potentially more pain for homeowners, who could see the value of their homes erode further as neighboring foreclosures sell.

Combined, bank-owned homes and those still in the foreclosure process sold for an average of $161,214 in the first quarter. That's down 1 percent from the fourth quarter of last year and down 2 percent from the first quarter of 2011.

Compared to non-foreclosure homes, the average price of a foreclosure sale was 27 percent below the average sales price of homes not in foreclosure or bank-owned during the quarter. That discount is unchanged from the fourth quarter last year, but is down from a discount of 29 percent in the first quarter of 2011.

Was Flame virus that invaded Iran's computer networks made in USA?

As the United Nations and Iran warn that the newly discovered Flame computer virus may be the most potent weapon of its kind, U.S. computer security experts tell NBC News that the virus bears the hallmarks of a U.S. cyber espionage operation, specifically that of the super-secret National Security Agency.

The Flame virus, which is intended to gather intelligence -- not destroy equipment or data, as was the case with the notorious Stuxnet virus -- is too sophisticated to be the work of another country, said one U.S. official, speaking on condition of anonymity. ?It was U.S.,? said the official, who acknowledged having no first-hand knowledge of how the virus operates or was introduced into the Iranian computers.

The U.S. was also believed to have a hand in the creation and insertion of the Stuxnet virus, which targeted Iran?s uranium-enriching centrifuges.


The newly discovered Flame virus essentially ?colonizes? the targeted computers, giving hackers control over critical data stored on them, according to cybersecurity experts who spoke with NBC News.

?

U.S. intelligence officials declined to discuss the virus. ?We have no comment,? said one. ?Israeli officials, suspected in previous attacks, denied involvement.

The virus was first discovered and announced over the weekend by a Russian cybersecurity organization after reports of massive data losses in Iranian government computers.? Kaspersky Lab told Reuters it found the Flame infection after the International Telecommunications Union asked it to investigate. By some accounts, the virus has been operating in the wild for as long as five years.

"This is the most serious (cyber) warning we have ever put out," Marco Obiso, cybersecurity coordinator for the U.N.'s Geneva-based ITU, told Reuters on Tuesday, referring to a bulletin about the virus expected to be issued in the next few days.

The confidential warning will tell member nations that the Flame virus is a dangerous espionage tool that could potentially be used to attack critical infrastructure, Obiso said.

Other experts said the virus appears to be a different type of invader than Stuxnet.

"From reading press reports, this appears to be penetrating networks to surveil, as opposed to destroy, as was the case with Stuxnet,? said Michael Leiter, former director of the National Counter Terrorism Center and now an NBC News analyst. ?Such computer network operations are core components of what our and other intelligence services do day in and day out.

?Our intelligence services know that any weakness in an information system can mean the entire system is vulnerable. ?This makes defense very, very hard.? Network defenses must work reliably and in real time across the entire network to defend against persistent intruders."

Iran?s cybersecurity officials seem to agree.? The New York Times reported Iran?s Computer Emergency Response Team Coordination Center issued a warning Tuesday, saying, ?This malware is a platform which is capable of receiving and installing various modules for different goals.?

If this is indeed a U.S. cyberwarfare operation, said computer security expert Roger Cressey, the target is likely to be Iran?s nuclear program and its decision-making apparatus.?

"Whoever has developed this is engaged in very sophisticated intelligence gathering on computer networks throughout the region.? Clearly, Iran is a top priority for this program," said Cressey, former chief of staff of ?the President?s Critical Infrastructure Protection Board under George W. Bush and now an NBC News analyst.

Two years ago, the U.S. and Israel were suspected of inserting the Stuxnet virus into the Iranian centrifuge center at Natanz.?When the control software was corrupted, the motors that control the uranium centrifuge operations didn?t operate correctly, wobbling instead of spinning the way they?re supposed to, U.S. officials say.

Iran?s President Mahmoud Ahmadinejad has said that the work of Kaspersky Labs helped Iran uncover the infection and remove it from the centrifuge control program.? Cybersecurity officials have told NBC News that the infection, while heavily publicized, was not as effective in disrupting Iran?s nuclear program as has been portrayed in some media accounts.

But Stuxnet is an example, said one U.S. official, of how those aiming to slow the Iranian nuclear program, which the U.S. says is aimed at producing nuclear weaponry, can have an effect similar to that of economic sanctions. The Iran program keeps making progress, he said, but never quite gets there.

Other U.S. officials said that the viruses not only affect the targeted program; they also make Iranian officials ?paranoid.? Additionally, countering the attacks diverts valuable assets and resources from the core mission, they said.?

While the Flame virus appears to be aimed more at gathering intelligence on the Iranian program, it, too, aims to make the Iranians paranoid, the officials said. It does so?by making them wonder about security and by raising questions about whether ?the enemy knows the intricacies of Iranian decision making, not just on the nuclear program but on a host of other issues important to the U.S. and the West, they said.

Halo's Space Command to quell conflict in Syria?

Earth has its very real?United Nations Security Council. The Halo games have their very fictitious United Nations Space Command.?The former was founded in 1946 and?is charged with the maintenance of international peace and security here on planet Earth and is currently struggling to?quell?the conflict in Syria. The latter was founded in 2163?and helped defeat?fascist?forces in the Interplanetary War on Mars and the Jovian Moons, not to mention created the?mechanically and biologically augmented?super soldiers known as Spartans.?

You'd think it wouldn't be that hard to tell the two apart ... and yet ...

Britain's very earth-bound BBC News at One program found itself using the logo from the Halo games' Space Command in place of the U.N. logo. The Halo image played in the background as BBC's Sophie Raworth discussed?Amnesty International's criticism of the U.N.'s handling of the conflict in Syria.

It's easy to see how it probably happened. A producer racing against deadline quickly searched for an image on the Internet and, bam, the BBC had itself a big ol' gaffe.?Honestly, as a busy reporter?under?constant deadline pressures myself, I feel their?pain. Still, you've gotta double check ... and then you have to triple check.

The BBC has, of course, apologized for the its mistake via?Eurogamer.

BBC News makes every effort to ensure the accuracy of all images broadcast, however very occasionally mistakes do happen. Unfortunately an incorrect logo was used during a segment on last week's News at One bulletin and we apologise to viewers for the mistake.?The image was not broadcast in our later bulletins.

But the BBC isn't the only news organization to make the same mistake. As Venture Beat pointed out, it seems the CanAsianTimes is?still using the Halo logo to illustrate a story from March?about the U.N.?Security Council's efforts to end the conflict in Syria.

Meanwhile, the incident brings to mind?last year's debacle?in which the British ITV channel showed footage of??IRA militants using heavy machine guns supplied by?Libya's Colonel Moammar Gadhafi?to shoot down a helicopter. The problem was, it was actually footage from the video game "ArmA 2."

A Rose by Any Other Name: International Crimes or Crimes Against ...

No matter what anyone may say, the names we give to concepts matter a great deal. They have an impact on the way we think about them. For example, in domestic American politics there is an ongoing debate over the value of the recent medical insurance overhaul. Those in favor of the modifications call it the ?Affordable Care Act?, while those who are against the changes call it ?Obama-care?. Both names apply to the exact same identical thing, but one brings forth a personal platform while the other implies a certain usefulness or characteristic. The name international law likewise has traditionally affected the way scholars and judges thought about the discipline. The name itself, ?inter-national?, implies that its rules apply to and among nations, or in modern terms, States.[1]

A terminology that started as a description of this branch of law has become its definition. This contributed to the assertion that ?inter-national? law does not apply or recognize, inter alia, individuals as subjects of the law.[2] While the exclusion of the individual as a subject of international law is still asserted by some, it is now commonly accepted that the individual is a subject of international law as the beneficiary of rights and assignments of duties in human rights law and international criminal law.[3] This has lead some to suggest that international law has evolved into something more akin to a global law.[4] My scope is much more modest in that I will focus on only one branch of international law. I would like to suggest that the time has come to reevaluate the name given to what we currently call ?international criminal law?. The basis for this reevaluation is two fold: (1) the name no longer reflects (if it ever truly did) the nature of the subject matter and (2) many national legal orders do not identify internationals crimes as ?international?, but rather have more nuanced names for the discipline. I will conclude by suggesting more accurate names to describe this discipline.

The first reason to discard the moniker of international criminal law relates to what the term itself means. As mentioned, the word ?inter-national? implies that the behavior or relationships to be regulated by this body of law occur between States. Criminal law, of course, references a body of law creating and punishing crimes. It is axiomatic that State crimes do not currently exist in modern international law. The International Law Commission?s Articles on State Responsibility do not include such a category of international violations even though such terminology was used in earlier drafts.[5] At the same time, international criminal tribunals do not have jurisdiction over States for the crimes within their jurisdiction even when those acts are attributable to a State.[6] The crimes themselves also do not envisage a State as the victim, but rather individuals or collectives of individuals.[7] Nothing about the perpetrator or the victim then is directly ?inter-national?.

The origin of international crimes, however, helps explain the terminology currently used in diplomatic and academic discourse. The first modern international criminal prosecutions took place at the end of the Second World War and were based primarily on violations of treaties.[8] Treaties, by definition, are ?inter-national? agreements.[9] The crimes were therefore acts in violation of ?inter-national? law. Additionally, the crimes were perpetrated in the context of a conflict between States and by individuals associated with one of the parties to that conflict and in furtherance thereof.[10] Neither of these conditions still holds in regards to modern international criminal law.

It is generally accepted that the laws of armed conflict criminalizing, inter alia, the mistreatment of protected persons, apply equally during ?inter-national? armed conflicts, intra-national armed conflicts and conflicts between two non-State groups within and between several States.[11] Under the last scenario, a conflict between two or more non-State groups, the consent of treaty law of a particular State is less relevant. Neither group necessarily has agreed to be bound by the laws of war. Consent however is not required because customary law criminalizes the behavior anyway. What we have under these conditions is a body of law that directly governs the acts of individuals working on behalf of non-State entities regardless of the consent or any specific State.

Outside of the arena of war crimes, it is also generally accepted that there is no need for State involvement for the commission of ?crimes against humanity?, an autonomous branch of international criminal law.[12] Groups that are unaffiliated with a particular State can set the widespread or systematic attack against a civilian population in motion that is necessary for their commission. Private individuals without the involvement of a State, likewise, can commit genocide.[13] These crimes therefore do not carry any link with States, let alone a connection to acts between States, to require the moniker of ?inter-national?.

As this brief description shows, the term ?inter-national? does not reflect the nature of the crimes under consideration. They do not necessarily relate to actions between States, but rather to certain acts that for one reason or another have been criminalized by the international community at the supranational level.

The second reason that reevaluating the name of ?international criminal law? is that the crimes normally associated with this name are often referred to under different names in national legal systems. I will list just a few here for the purpose of illustration. Cape Verde criminalized ?inter-national? crimes in a section of its penal code called ?Crimes Against the International Community?; Estonia refers to these crimes as ?Offenses Against Humanity and International Security?; France refers to them as ?Crimes Against Humanity and Against Persons?; Georgia calls them ?Crimes Against Humanity?; Guatemala calls them ?Crimes of International Transcendence?; and some former Soviet States refer to the crimes as ?Crimes Against Peace and Safety of Mankind?. There is little if any continuity between these terms and even less with the idea of ?inter-national? crimes.

The lack of any meaningful connection to the term ?inter-national? and the diversified practice of naming the same discipline within national legal systems both suggest that the name ?international criminal law? is on its way to being an anachronism if it is not already. There still remains the question of what the discipline should be called. One option would be to use the classic Latin phrase crimes hostis humani generis. Another option would be to invent a new term such as ?crimes against global order? or ?crimes of universal concern?. The better choice would be to adapt the term ?Crimes Against Humanity? to describe the entire field of law instead of a single subset of crimes. This has already been done implicitly by some of the national systems listed above. The sub-branch of the field now referred to as crimes against humanity can be referred to as ?human rights crimes? thereby further casting light on its relationship both to human rights law and its separation from war crimes and humanitarian law.[14] This kind of renaming scheme would better reflect the content of the law and its modern context.

N.J. Mayor, Son Arrested For Hacking Political Rival's Website

A New Jersey mayor has been arrested along with his son on charges they conspired to hack a Website calling for the mayor's ouster as part of a campaign to target the mayor's critics.

We loved her post and asked her if we could share it with all of you (thinking you might want to pass it along to certain members of your household!) and to add a few words of advice for parents as well. ?If only all twenty year olds were this sensible?.

Dear Parents,
A little intro from a senior in college and three-time champion of the smooth transition home for the summer. As the third child among my parents? four darlings, I wasn?t the first college kid to come home for the summer and attempt to ?rule the roost,? as my dad likes to say. The easy (ok, occasionally traumatic) transition was made possible by my two adoring parents who wanted nothing but the best for their kids.The thing to keep in mind when laying down the law in your home, from the perspective of a college student, is to remember that we?ve been on our own for a year (or two, or three, or four) now, and we?ve gained a lot of independence. Sure the messy rooms, the lack of ability to do laundry and the spoiled attitude might say otherwise, but the reality is, we?ve thrown ourselves into new situations without the safety net of parents and have matured in ways that might not jump off the page?just yet.

It?s tough coming home to the requests of parents when, for so long, we?ve been planning our days just the way we want them: wake up at ten, go to class, workout, get lunch with friends?etc?etc?.

A lot of parents won?t see the maturity of their kids when they come home for summer, because the truth is, we regress back to our high school selves. We know our parents are there to dish out a few bucks, to say no when we ask to do certain things, and to encourage us to get off the couch and to do something active, so we?re relaxed.

At school, we don?t have this back up, and we?re forced to discipline ourselves, but you will never see that whilst we?re in the comfort of our homes. Even if your kids are acting like their seventeen ? year old selves, try not to treat them as you did in the past, and hopefully they?ll get the picture. If you give them the independence they had in college, they will be encouraged to show you just how much they?ve matured while at school.

Keep in mind that your parents are watching your every move as soon as you get back. It can?t hurt to be on your best behavior for a couple of days as you settle in.

Curfew?
If your parents try to reinstate your old curfew, chances are you haven?t been on your best behavior. Stating a curfew is a means of control and if your parents are dating back to the high school years it?s most likely because they feel like you need rules to follow. If you are being responsible, checking in and acting mature, you should not have to worry about the old 1 am curfew coming back to haunt you.

Get a Job
Laying out in the sun and bumming around the house all day sounds like an ideal summer to most of us, but the reality is that we are in college and should be taking on the responsibilities of a job and making money. If you?re working hard your parents will take notice and not come down on you for petty things. It will be easier to ask for that extra cash for the concert at the end of the month if your parents know you?re doing your part, as well.

We can all agree it?s a lot harder in the guy department while living under your parents? roof. At school, it?s easy to hang out at your apartment with your guy. You never have to worry about introducing him to the fam.
